The European Court of Human Rights is an international court based in Strasbourg, France. It is independent of national courts and does not represent national authorities. The European Court of Human Rights considers violations of human rights protected by the European Convention on Human Rights. For example, the prohibition of torture and other ill-treatment; the prohibition of collective expulsion of foreigners; unlawful detention. See also the answers to questions 4 and 5.
Your application for asylum should be considered by the country you entered first. There are, however, exceptions to this rule. Firstly, family circumstances are taken into account. If an immediate family member (e.g. spouse or child under 18) has been granted or is seeking asylum in another European Union country, you can also apply for asylum in that country. Secondly, you can file an asylum application in another European Union country if there are serious reasons to believe that applying for asylum in the country of "first entry" is ineffective. For example, if the authorities do not assess your individual circumstances.
No. The European Court of Human Rights cannot grant you asylum or a residence permit in the receiving country. If the Court finds a violation of your rights, you can use the decision to apply for asylum in this country.
You can expect to receive fair compensation for the violation of your rights. Based on the practice of the European Court of Human Rights in similar cases, the amount of compensation ranges from €5,000 to €34,000.
The Court decides on interim measures within 1 or 2 days. Interim measures are urgent measures that the European Court of Human Rights grants if a person is at risk of irreparable damage. Earlier, in cases of pushbacks at the border, the Court granted such a measure by indicating the authorities not to remove a person from the country pending a final decision.
